6. If the Seller, at any time including after creation of the agreement, considers the credit of the Buyer unsatisfactory the Seller may: (a) need security for payment of the Purchase Price. The items shall be considered to have been absolutely accepted by the buyer on the date when shipment has actually been made ex-works or to an address in accordance with purchaser's delivery directions, unless we receive composed notification of flaws with adequate and valid reasons within 7 days of the shipment date.
10. The Seller is not accountable for any loss or damage to the Goods in transit. The Seller shall render to the Purchaser such support as might be needed to make claims on carriers supplied the Purchaser notified the Seller and the providers in writing instantly, such loss or damage is found.
At our alternative, we may supply surplus products as a precaution versus damage or loss. On completion of the contract any surplus materials will remain the property of Flex Physical fitness Devices and will be promptly eliminated from website. 12 (Nutritionist in Carramar ). The provision of labour and an ideal forklift for the discharging of our materials and dealing with on to the erection website and/or covered storage location is the responsibility of the purchaser, unless otherwise concurred in composing.
13. Where the storage is at an area remote from the installation site, transfer of our products to website is the responsibility of the buyer.
14. Additional costs incurred in compensating for a malfunctioning or unequal flooring will be to the buyer's account. 19. We schedule the right to assign or subcontract out the whole or any part of this contract at our discretion.
At any times priced quote for our completion or delivery work from the date of invoice by us of a written order to continue, together with all details and details we need to proceed with the manufacture without disturbance or delay. All such times are to be dealt with as quotes just and we will not be responsible for failure to dispatch, install, or otherwise perform within such times unless otherwise concurred in composing.
21. The Buyer shall pay the Seller immediately. If the Buyer fails to make a payment by the due date, the Seller may, without notification, withhold delivery of any additional Goods to the Purchaser and may end, without liability to the Buyer, any or all surviving agreements between the Seller and the Buyer.
If payment is not made on the due date, the Seller may charge interest on the quantity payable at the rate of 5% over the 90 day bank bill rate suitable on the day the payment is due. 23. The Purchase Cost is not inclusive of goods and services tax, unless otherwise defined in composing.
